Thailand's Election Commission Requests Constitutional Court To Interpret Ruling On Termination Of Limjaroenrat's Membership

In a significant development, the Election Commission in Thailand has submitted a request to the Constitutional Court, seeking an interpretation of the Constitution regarding the termination of membership of Mr. Pita Limjaroenrat, a member of the People's Representative Council. The request is made in accordance with Article 101 (6) combined with Article 98 (3) of the Constitution, as stated in Case No. 23/2566.
The Election Commission, acting as the petitioner, has presented the case of Mr. Pita Limjaroenrat, a member of the People's Representative Council who allegedly holds shares in ITV Public Company Limited.
This business entity is engaged in publishing and other mass media activities, which is a violation of the requirements for council membership as outlined in Article 101 (6) combined with Article 98 (3). Consequently, the Election Commission has requested the Constitutional Court to issue an order suspending Mr. Limjaroenrat's duties until a judgment is rendered, as per Article 82, paragraph two. They have also urged the Court to include the member's name on the list from the day the Constitutional Court issues its judgment, in accordance with Article 105, paragraph one (2).
After careful deliberation, the Constitutional Court thoroughly examined the presented facts, the petition, and supporting documents. Subsequently, the Court passed a resolution in response to the matter, stating the following:
The Court found that the facts presented in the petition and supporting documents are in compliance with the Constitution, specifically Article 82, paragraph four, combined with paragraph one. Additionally, the Court considered the Royal Decree concerning the Constitutional Court's method of adjudication, B.E. 2561, Article 7 (5).
Therefore, the Court has accepted the petition for adjudication and has ordered the defendant to submit a statement explaining the allegations within eighteen days from the date of receiving a copy of the petition, as per the Royal Decree concerning the Constitutional Court's method of adjudication, B.E. 2561, Article 54.
Regarding the petitioner's request to suspend Mr. Pita Limjaroenrat's performance of duties under Article 82, paragraph two, the Constitutional Court voted with a majority (7 out of 9) in favor of the decision. The Court concluded that there are sufficient grounds to suspect the alleged violations, which could lead to legal complications and adversely affect the important work of the Parliament and the People's Representative Council. Consequently, the Court has issued an order to suspend Mr. Limjaroenrat's performance of duties as a member of the People's Representative Council, effective from July 19th, 2566, until a judgment is reached by the Constitutional Court.
