ICC Hands Duterte's Defense 139 New Evidence Files In Crimes Against Humanity Case

The International Criminal Court (ICC) has just handed over a second batch of evidence to his defense team in connection with the crimes against humanity case filed against him.

According to a document posted on the ICC website on May 5, the Office of the Prosecutor disclosed 139 items of evidence to Duterte’s lawyers on April 30. These items are all linked to allegations of widespread and systematic killings under Duterte’s leadership—both as Davao City mayor and later as president.

But don't expect the juicy details just yet. The ICC noted that the annexes containing specifics about the documents are confidential for now, as they contain sensitive material.

Here’s what we do know:
The 139 items were grouped into four separate “Pre-Confirmation INCRIM Packages,” each focusing on a different aspect of the case:

28 items relate to the broader context of the crimes against humanity charges,
85 items deal with how the crimes were carried out and who’s liable,
1 item focuses specifically on alleged murders during Duterte’s time as Davao City mayor,
and 15 items are tied to barangay clearance operations during his presidency, also allegedly involving murders.
These documents are reportedly the same ones referenced in the ICC’s warrant of arrest for Duterte.

This is the second set of disclosures from ICC Prosecutor Karim Khan’s office—the first batch was turned over back in March.

Looking ahead, all eyes will be on the pre-trial hearing scheduled for September 23, when the ICC will decide if there’s enough evidence to move forward with a full-blown trial.
