COMELEC Greenlights Proclamation Of Marikina Mayor Marcy Teodoro As Congressman

The Commission on Elections (COMELEC) en banc has officially ruled in favor of incumbent Marikina City Mayor Marcelino “Marcy” Teodoro, clearing the way for his proclamation as the duly elected representative of Marikina’s 1st District in the House of Representatives.

The decision comes after COMELEC reversed an earlier ruling by its First Division issued in December 2024, which had ordered the cancellation of Teodoro’s Certificate of Candidacy (COC) due to alleged misrepresentation of his residence and voter registration. In a 4-0-3 vote, with three commissioners taking no part in the deliberation, the en banc body granted Teodoro’s Consolidated Motion for Reconsideration, effectively reinstating his candidacy.

The petitions had questioned the legality of Teodoro’s voter registration, accusing him of strategically transferring his residence between districts for political convenience. The petitioners also argued that this demonstrated a deliberate attempt to circumvent election laws. However, the Commission found these claims unsubstantiated.

After a detailed review of the evidence and jurisprudence, the COMELEC ruled that there was no material misrepresentation on Teodoro’s part. In fact, it emphasized that Teodoro is neither a stranger nor a newcomer to the 1st District of Marikina. As a three-term former congressman of the same district, and with San Roque—his declared residence—being his domicile of origin, the Commission asserted that he meets the residency and voter registration requirements set by the Constitution.

The resolution also underscored that the core objective of these legal provisions is to ensure that elected officials are genuinely familiar with the communities they serve. In Teodoro’s case, his long-standing public service in the 1st District demonstrates his deep familiarity with the area’s needs, challenges, and potential for growth.

With the lifting of the suspension of his proclamation, Mayor Teodoro is now set to be officially declared as the representative of Marikina’s 1st District in the House. This clears the path for him to return to Congress, this time after a successful stint as city mayor.

The case, which consolidated two separate petitions (SPA No. 24-196 and SPA No. 24-224), highlights not only the complexity of election laws but also the delicate balance between legal technicalities and the electorate’s right to choose their leaders. Teodoro himself stressed in his motion that the heart of the issue was not merely his candidacy but the broader right of the people of Marikina to elect a representative of their own choosing.
