SC Gives Respondents 10 Days To Comment On Duterte-Dela Rosa ICC Petition

The Supreme Court En Banc has given respondents 10 days to comment on a petition filed by former President Rodrigo Duterte and Senator Ronald Dela Rosa challenging Duterte’s potential arrest and the Philippine government’s cooperation with the International Criminal Court (ICC).
The petitioners filed a Very Urgent Manifestation on November 13, 2025, alleging that former Justice Secretary Jesus Crispin Remulla had publicly stated that an ICC arrest warrant had already been issued against Dela Rosa. They also claimed that a diffusion order against Dela Rosa was in place, that the government could surrender him to the ICC without extradition proceedings, and that at least three witnesses had been placed under the Witness Protection Program at the ICC’s request.
The Supreme Court also denied a separate Very Urgent Motion filed by Duterte and Dela Rosa on November 12, which sought to compel the production of the alleged ICC warrant that Remulla reportedly possessed.
Duterte and Dela Rosa first filed the petition on March 11, 2025, challenging Duterte’s potential arrest and the government’s cooperation with the ICC. They later filed the motion asking the Supreme Court to order the Ombudsman and Remulla to submit a copy of the alleged ICC warrant.
In their manifestation, the petitioners also requested the Supreme Court to take judicial notice of Remulla’s statements and to direct the Department of Justice and the Department of Foreign Affairs to certify the existence or absence of any official ICC-related warrants or communications.
Finally, the petitioners sought a preliminary injunction, citing a “clear, present, and continuing danger” that Senator Dela Rosa could be illegally arrested or surrendered to a foreign court without due process.
