House Prosecutors Push For Clearer Defense Evidence In VP Duterte Impeachment Case

House prosecutors have asked the Senate impeachment court to require Vice President Sara Duterte’s defense panel to provide more detailed explanations on the purpose and relevance of each witness and document listed in its pre-trial submission, citing the need for clearer framing of issues ahead of trial.

The request was filed in a pleading before the impeachment court, where the prosecution said it reviewed the defense’s pre-trial brief and found that many proposed witnesses and exhibits were described in broad, repetitive terms.

The impeachment proceedings against Duterte are currently in the pre-trial phase before the Senate acting as an impeachment court, with formal trial proceedings expected to begin on July 6.

According to the prosecution, several defense witnesses were generally presented as intended to “disprove the allegations in the Articles of Impeachment,” address claims in Duterte’s answer, identify documents, or cover related matters—without specifying which allegations each witness will directly respond to.

A similar pattern, prosecutors said, was observed in the list of documentary evidence, where multiple exhibits were also described using nearly identical and generalized language.

Lead prosecutor Atty. Gerville Luistro of Batangas said the issue is not the volume of evidence the defense intends to present, but the lack of clarity on what each item is meant to prove.

“The issue is not the number of witnesses or exhibits being presented,” lead prosecutor Atty. Gerville “Jinky Bitrics” Luistro of Batangas explained. “The issue is whether the court is given enough information to understand what each witness is expected to prove and why each document is relevant.”

The prosecution said clearer descriptions are necessary to help the court properly organize the trial, avoid duplication of testimony, and streamline the presentation of evidence once proceedings begin.

Luistro also pointed out that pre-trial procedures are designed to narrow down issues in dispute and ensure both sides clearly define their evidence before the full trial starts.

Without more specific identification, prosecutors warned that the court may struggle to determine whether multiple witnesses will testify on the same issues or whether certain documents overlap in purpose.

Despite its request, the prosecution emphasized that it is not seeking to block or exclude any witness or piece of evidence from the defense.

Instead, they are asking the court to require a more detailed explanation of what each witness and document is expected to establish in relation to the impeachment charges.

“The request is fundamentally about clarity,” Luistro said. “If a witness is important to the defense, the court should know what specific issue that witness will address. If a document is relevant, the court should know what fact it is intended to prove.”

In its filing, the prosecution asked the impeachment court to direct the defense to submit a more particularized description of each witness and exhibit before the trial proceeds.

The impeachment case is now moving through final pre-trial preparations, with both sides expected to refine their evidence lists ahead of the formal proceedings in July.
