SC Dismisses Discaya Appeal, Case Moves Forward

The Supreme Court of the Philippines has dismissed the petition filed by Cezarah Rowena C. Discaya, clearing the way for her case to proceed in court over alleged corruption-related offenses.

In a press briefer, the High Court said the petition questioning the Ombudsman’s finding of probable cause had already become moot. This came after formal charges were filed before a Regional Trial Court, which has since issued a warrant of arrest against Discaya.

The case involves alleged violations of the Anti-Graft and Corrupt Practices Act, as well as charges of malversation and falsification of public documents.

According to the Court, determining probable cause is the exclusive function of prosecutors, and courts generally do not interfere in such findings unless there are clear exceptions—none of which were established in this case.

The charges stem from a complaint filed by the Department of Public Works and Highways (DPWH) involving a government project in Davao Occidental.

Authorities alleged that a concrete revetment project in Culaman, Jose Abad Santos was fully paid despite not being completed. The project, reportedly worth ₱96.5 million, was awarded to a construction firm linked to Discaya.

With the petition now dismissed, the case is expected to proceed before the trial court, where the allegations will be formally examined and resolved.
